Wyoming Performance & Payment Bond

Wyoming requires a bond from the contractor on public works contracts over $150,000, under Wyo. Stat. § 16-6-112. The bond must equal 100 percent of the contract price.

License bondSet by cities and counties

Wyoming Contractor License Bond

Wyoming has no statewide general contractor license bond. Cities and counties set their own licensing and bonds. For example, the Town of Jackson requires a surety bond of $20,000 to $250,000 depending on license class.

Wyoming Mechanic's Lien Discharge Bond

In Wyoming, an owner, contractor or subcontractor can discharge a mechanic's lien by filing a surety bond, letter of credit or cash with the court. The security must equal one and one-half times the lien amount.

Wyoming Subdivision Bond

Wyoming counties approve subdivisions under Wyo. Stat. § 18-5-306, which requires the subdivider to provide a performance bond, acceptable letter of credit or other sufficient financial commitment so that the proposed facilities are completed. The amount reflects the estimated cost of the facilities and is set by the county.

Wyoming Maintenance Bond

No Wyoming statute requires a maintenance bond in general. The public works bond law, Wyo. Stat. § 16-6-112, requires a bond of 100% of the contract price on public works over $150,000; any separate maintenance or warranty bond is set by the contract or local rules.

Permit bondRequired by state law

Wyoming Right-of-Way Bond

On state highways, the Wyoming Department of Transportation may require a bond with an access or encroachment permit to guarantee the work and cover damage to the highway. Counties and cities set bonds for work on their own roads; Carbon County, for example, may require a cash or surety bond for utility permits.

Wyoming Permit Bond

Wyoming has no statewide permit bond. Cities and counties set bonds for their own permits; for example, Cheyenne requires a $500 to $2,500 cash bond for a demolition permit, refunded after the required inspections.

Wyoming Supply Bond

No Wyoming statute requires supply bonds. The state bond law, Wyo. Stat. § 16-6-112, applies to public works contracts over $150,000; a bond on a supply contract is set by the buyer.

Wyoming Stop Payment Notice Release Bond

Wyoming has no stop payment notice procedure. On public works, unpaid subcontractors and suppliers claim against the contractor's bond under Wyo. Stat. § 16-6-112, and on private jobs they use mechanic's liens, so there is no stop notice release bond.

Wyoming Notary Bond

Wyoming has not required a notary bond since its new notary law took effect on July 1, 2021. A notary may buy a bond or errors and omissions insurance, but it is not filed with the state or county.

Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
