Contract bondFreeRequired by state law

Montana Bid Bond

Montana public bodies must require bid security on public works and other covered contracts, under 18-1-201, MCA. The minimum is 10% of the bid price, and a bid bond from a surety authorized in Montana is accepted.

Montana Performance & Payment Bond

Montana public construction contracts require a bond of at least the contract sum, covering both performance and payment of laborers, subcontractors and suppliers, under 18-2-201, MCA. The bond may be waived on projects under $150,000.

License bondNot used in this state

Montana Contractor License Bond

Montana requires a construction contractor license from the Department of Labor and Industry from January 1, 2026, under 37-45-201, MCA, but the license law does not require a surety bond. State law bars cities and counties from issuing their own licenses or bonds for the same purpose.

Court and release bondRequired by state law

Montana Mechanic's Lien Discharge Bond

In Montana, an owner, original contractor or subcontractor may release a construction lien by filing a bond or cash of 1 1/2 times the lien amount with the district court clerk, under 71-3-551, MCA.

Development bond3%, $250 minSet by cities and counties

Montana Subdivision Bond

Montana local governing bodies may accept a bond or other reasonable security from a subdivider in place of finishing required improvements before final plat approval, under 76-3-507, MCA.

Montana Maintenance Bond

Montana's public works bonding statute (Mont. Code Ann. § 18-2-201) mandates performance and payment bonds on state and municipal construction contracts but says nothing about a separate maintenance or warranty bond. No other Montana statute requires one; owners may demand it by contract at their own discretion, typically for one year of post-completion defect coverage.

Permit bondSet by cities and counties

Montana Right-of-Way Bond

Montana cities set their own bonds for digging in streets and other public places. For example, Billings requires a separate excavation bond under Article 22-300 of the Billings city code.

Montana Permit Bond

Montana permit bonds are set by cities. For example, Billings requires a utility bond from contractors who connect to public sewers or install building sewers under Section 6-512 of its city code.

Montana Supply Bond

Montana's Procurement Act (Mont. Code Ann. § 18-4-312) expressly gives state procurement departments discretion to require security — including a surety bond — on supply and services contracts, but does not mandate it. No other Montana statute creates a blanket supply-bond requirement; coverage is determined contract by contract based on risk.

Montana Stop Payment Notice Release Bond

Montana has no stop payment notice (stop notice) statute. Unpaid subcontractors and suppliers protect themselves through construction liens under Mont. Code Ann. § 71-3-521 et seq. The closest analog is a lien bond substitution under § 71-3-551, which lets a property owner, general contractor, or subcontractor discharge a recorded construction lien by filing a bond equal to 1.5 times the lien amount — but this is triggered by a recorded mechanics lien, not a stop notice.

Commercial bondRequired by state law

Montana Notary Bond

Montana notaries must get a $25,000 surety bond or its functional equivalent, and the Secretary of State issues a 4-year commission, under 1-5-619, MCA.

Federal bondFrom $2,250/yrRequired by federal law

Montana Freight Broker Bond (BMC-84)

Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
