Contract bondFreeRequired by state law

Indiana Bid Bond

Under IC 36-1-12-4.5, Indiana political subdivisions must require a bond or certified check with each bid on public works estimated to cost more than $200,000. The board sets the amount in the notice, up to 10% of the contract price.

Indiana Performance & Payment Bond

For local public works over $200,000, Indiana requires a payment bond equal to the contract price under IC 36-1-12-13.1 and a performance bond equal to the contract price under IC 36-1-12-14. State agency projects follow IC 4-13.6-7.

License bondSet by cities and counties

Indiana Contractor License Bond

Indiana has no statewide general contractor license or license bond. Cities and counties that license contractors set their own bonds; for example, Indianapolis requires a $10,000 surety bond for a general contractor license, payable to the Consolidated City of Indianapolis and/or an unknown third party.

Court and release bondRequired by state law

Indiana Mechanic's Lien Discharge Bond

Under IC 32-28-3-11, an owner or other interested party may file a written undertaking with surety, approved by the court, to release property from a mechanic's lien. The undertaking must cover any judgment on the lien, plus costs and attorney's fees.

Indiana Subdivision Bond

Under IC 36-7-4-709, a plan commission may grant secondary plat approval before improvements are finished if the developer posts a bond or other proof of financial responsibility set by the local subdivision control ordinance.

Contract bondSet by cities and counties

Indiana Maintenance Bond

Indiana cities, towns and counties may require a maintenance bond for subdivision improvements, but state law (IC 36-7-4-709(f)(2)) bars them from requiring a maintenance bond lasting more than three years from a developer of Class 1 or Class 2 structures. On other projects the contract sets it.

Permit bondRequired by state law

Indiana Right-of-Way Bond

INDOT requires a performance bond with each application for a commercial driveway permit on a state highway under 105 IAC 7-1-14. The minimum is $5,000, raised to the estimated cost of the work on INDOT right-of-way.

Permit bondSet by cities and counties

Indiana Permit Bond

Indiana has no statewide permit bond for building or work permits. Cities and towns set their own; for example, Greenwood requires an excavation permit bond of at least $15,000 payable to the city for work in streets, alleys, sidewalks or right-of-way.

Contract bondSet by the contract

Indiana Supply Bond

No Indiana statute requires supply bonds. Indiana's public works law requires bid security of up to 10% (IC 36-1-12-4.5), a performance bond (IC 36-1-12-14) and a payment bond (IC 36-1-12-13.1) on public works; a bond on a supply contract is set by the buyer.

Indiana Stop Payment Notice Release Bond

Indiana has no stop payment notice release bond. On local public works, an unpaid subcontractor or supplier files a claim with the board within 60 days, and the board withholds the claim amount until it is resolved (IC 36-1-12-12); the statute does not provide a bond to release that money.

Commercial bondRequired by state law

Indiana Notary Bond

Indiana notaries must obtain a $25,000 assurance, such as a surety bond, under IC 33-42-12-1. Commissions last eight years.

Federal bondFrom $2,250/yrRequired by federal law

Indiana Freight Broker Bond (BMC-84)

Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
