Delaware Maintenance Bond

Delaware's public works law, 29 Del. C. § 6962, requires a bid bond of at least 10% of the bid and a performance bond of 100% of the contract price on large public works contracts, but does not require a separate maintenance or warranty bond. When one is used, the contract or local agency sets it.

Permit bondRequired by state law

Delaware Right-of-Way Bond

DelDOT requires security, such as a surety bond, for commercial entrances and off-site improvements on state-maintained roads under its Development Coordination Manual.

Permit bondSet by cities and counties

Delaware Permit Bond

Delaware has no statewide building permit bond; counties and cities set their own. New Castle County requires permit-endorsed contractors to file a Statutory Compliance Bond with their county license, with amounts set by license class, for example $150,000 for a Class A building contractor.

Contract bondRequired by state law

Delaware Supply Bond

Delaware law lets state agencies require bonds on contracts for materiel (supplies) under 29 Del. C. § 6927: a bid bond or security of at least 10% of the bid, and a performance bond generally equal to 100% of the contract award. For smaller material purchases the requirement can be reduced or waived if the bid specifications say so.
