Maryland Bid Bond
Maryland state procurement law requires bid security of at least 5% of the bid on state construction contracts above the small procurement amount.
Maryland Performance & Payment Bond
Maryland's Little Miller Act requires payment security and performance security before a public body awards a construction contract above the small procurement amount.
Maryland Contractor License Bond
Maryland home improvement contractor applicants who cannot show the required financial solvency may file a $30,000 surety bond with the Maryland Home Improvement Commission (MHIC).
Maryland Mechanic's Lien Discharge Bond
In Maryland, the court order on a mechanic's lien petition states the amount of a bond the owner may file to release the land and building from the lien.
Maryland Subdivision Bond
Maryland counties and cities set subdivision improvement security in their own codes. For example, Washington County has the developer sign a Public Works Agreement backed by a performance bond to the County Commissioners, guaranteeing the subdivision infrastructure is built under County Policy S-3.
Maryland Maintenance Bond
No Maryland statute requires a maintenance bond statewide. Counties set them for public infrastructure they take over; for example, Washington County requires a maintenance bond that covers repair of damage from faulty materials or workmanship after it conditionally accepts subdivision infrastructure. On other jobs the contract sets it.
Maryland Right-of-Way Bond
Work on Maryland state highways needs an MDOT State Highway Administration permit, and access permit applications call for a bond, letter of credit or certified check.
Maryland Permit Bond
Maryland has no statewide permit bond; counties set them. Montgomery County's Department of Permitting Services requires a bond for demolition, sediment control and public right-of-way permits, posted before the construction permit is issued.
Maryland Supply Bond
No Maryland statute requires supply bonds. Under COMAR 21.06.07.10, a state procurement officer may require a performance bond on a supply, service or maintenance contract expected to exceed the small procurement amount; for construction contracts it is required.
Maryland Stop Payment Notice Release Bond
Maryland does not have a stop payment notice procedure. Unpaid contractors and suppliers use mechanic's liens on private projects and payment bonds on public construction contracts (Md. Code, State Fin. & Proc. § 17-103).
Maryland Notary Bond
Maryland does not require a notary bond. Notaries are commissioned for four-year terms through the Secretary of State. A 2011 bill (HB 894) that would have added a $1,000 notary bond did not become law.
Maryland Freight Broker Bond (BMC-84)
Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
