New Mexico Bid Bond
New Mexico requires bid security of at least 5 percent of the bid on competitively sealed construction bids estimated to cost more than $25,000. Section 13-4-18.1 NMSA 1978 covers how bid security may be given.
New Mexico Performance & Payment Bond
New Mexico requires a performance bond and a payment bond on construction contracts over $25,000 for state agencies and local public bodies. The performance bond is 100 percent of the contract price.
New Mexico Contractor License Bond
New Mexico requires a $10,000 bond for contractor licenses issued by the Construction Industries Division, under NMSA 1978 Section 60-13-49. The bond must be kept for the whole period of licensure.
New Mexico Mechanic's Lien Discharge Bond
In New Mexico, a property owner or original contractor can ask the district court to cancel a mechanic's lien by filing a surety bond. The court sets the bond, generally at 150 percent of the lien claim.
New Mexico Subdivision Bond
New Mexico enabling statutes authorize municipalities (NMSA § 3-19-6) and counties (NMSA § 47-6-9) to require a developer to post a bond before final subdivision plat approval, securing construction of streets, utilities, and other public improvements. The bond amount and conditions are set by the local planning commission; no statewide fixed dollar amount is prescribed. In lieu of a bond, a municipality may accept a written agreement requiring the developer to complete improvements within two years of final plat approval.
New Mexico Maintenance Bond
New Mexico's public works bonding statute (NMSA § 13-4-18) requires only performance and payment bonds for contracts over $25,000; it does not mandate a separate maintenance or warranty bond. NMDOT Standard Specifications (sections 103.6 and 106.10) may require a warranty bond tied to specific highway bid items, but that requirement is imposed by contract, not statute. The $10,000 contractor license bond (NMSA § 60-13-49; 14.6.3 NMAC) covers certified code violations for up to two years after final inspection but is a license bond, not a standalone maintenance bond.
New Mexico Right-of-Way Bond
No New Mexico statute universally requires a surety bond for all right-of-way or encroachment permits. NMDOT's utility accommodation regulation (17.4.2 NMAC) emphasizes insurance and states only that 'if a bond is required' the utility must provide proof, making it conditional rather than mandatory statewide. Cities and counties set their own requirements; the City of Albuquerque, for example, requires a $10,000 excavation/right-of-way surety bond for all contractors working within city right-of-way under its Street Excavation & Barricading Ordinance, plus an additional $5,000 bond for concrete sidewalk or curb work.
New Mexico Permit Bond
New Mexico has no statewide building permit bond separate from the contractor license bond. NMSA § 60-13-49 and 14.6.3 NMAC require all licensed contractors to carry a $10,000 surety bond covering certified code violations within two years of final inspection; this bond is tied to licensure, not to individual permits. Under NMSA § 60-13-45, trade bureaus may separately require an inspection-fee bond of $500 to $1,500. Cities and counties may require additional permit-specific bonds, but state law prohibits municipalities from requiring licensed contractors to obtain a second license bond.
New Mexico Supply Bond
New Mexico has no statute requiring a standalone supply bond on public supply or equipment-only contracts. Material and equipment suppliers on public construction contracts over $25,000 are protected by the payment bond required under NMSA § 13-4-18 (New Mexico's Little Miller Act), which covers all persons 'supplying labor and material' to the contractor or subcontractors, with a right to sue on the bond after 90 days of nonpayment under § 13-4-19. A standalone supply bond guaranteeing a supplier's delivery on a supply-only purchase contract is not required by New Mexico law and would be a contract-imposed requirement.
New Mexico Stop Payment Notice Release Bond
New Mexico's Stop Notice Act (NMSA §§ 48-2A-1 through 48-2A-12) applies only to residential construction with four or fewer dwelling units. An unpaid subcontractor or supplier may serve a stop notice on the owner or construction lender, but must accompany it with a surety bond (claimant as principal) at 125% of the claimed amount per § 48-2A-7. The original contractor may discharge the stop notice by posting a release bond at 125% of the claim amount with a corporate surety as co-signer under § 48-2A-10, redirecting the claimant's remedy to the bond.
New Mexico Notary Bond
New Mexico notaries must file a $10,000 surety bond with their application. The Secretary of State commissions notaries for four years.
New Mexico Freight Broker Bond (BMC-84)
Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
