Contract bondFreeRequired by state law

Tennessee Bid Bond

Tennessee requires a bid bond of 10 percent on construction manager contracts for public work, under T.C.A. 62-6-129. Bid security on other public works is usually set in the bid documents by the awarding body.

Tennessee Performance & Payment Bond

Tennessee requires a bond on public works contracts over $100,000 under T.C.A. 12-4-201. The bond must be at least 25 percent of the contract price.

License bond2%, $100 minRequired by state law

Tennessee Contractor License Bond

Tennessee does not require a general contractor license bond for every license. Home improvement contractors licensed by the Board for Licensing Contractors must file a $10,000 surety bond (T.C.A. Title 62, Chapter 6, Part 5).

Court and release bondRequired by state law

Tennessee Mechanic's Lien Discharge Bond

In Tennessee an owner or prime contractor can record a bond with the register of deeds to discharge a lien under T.C.A. 66-11-142. Recording a valid payment bond can also discharge the lien.

Development bond3%, $250 minSet by cities and counties

Tennessee Subdivision Bond

Tennessee regional planning commissions may approve a final plat when a bond or letter of credit covers unfinished improvements, under the subdivision powers in T.C.A. 13-3-402 and 13-3-403. Amount and form are set by the commission.

Tennessee Maintenance Bond

Tennessee's public works bonding statute, T.C.A. § 12-4-201, mandates payment and performance bonds on public contracts exceeding $100,000 but does not require a separate maintenance or warranty bond. No other state statute requires one statewide. Project owners—public or private—may include maintenance bond requirements in individual contract documents.

Permit bondRequired by state law

Tennessee Right-of-Way Bond

TDOT uses surety bonds for utility work in state highway right-of-way. A Running Surety Bond can cover all approved use and occupancy agreements in an area, in an amount set by the Regional Utilities Engineer.

Tennessee Permit Bond

T.C.A. § 62-6-137 is a state enabling statute that allows any municipality or county to require permit bonds from contractors, but only after the local governing body adopts the requirement by a two-thirds vote. Bond amounts are fixed by the statute: $10,000 for building permits under $25,000, $50,000 for building permits of $25,000 or more, and $40,000 for gas/mechanical, plumbing, and excavation permits. Several Tennessee jurisdictions including Nashville/Davidson County have adopted permit bond requirements under this authority.

Tennessee Supply Bond

Tennessee has no statute specifically requiring a supply bond on standalone material or equipment supply contracts. T.C.A. § 12-4-201 (the Little Miller Act) requires a payment bond on public construction contracts over $100,000, which protects suppliers furnishing materials to those jobs, but that is a payment bond rather than a supply bond. Tennessee's state procurement regulation, Tenn. Comp. R. & Regs. 0690-03-01-.07, authorizes proposal bonds (up to 5% of estimated contract value) and performance bonds on state procurement contracts but does not list supply bonds as a separate required category. Owners may require supply bonds through contract terms.

Tennessee Stop Payment Notice Release Bond

Tennessee does not have a stop payment notice mechanism. Unpaid subcontractors and suppliers on private projects protect themselves through Tennessee's mechanic's lien law (T.C.A. Title 66, Chapter 11) rather than by serving stop notices on construction lenders. Because there is no stop payment notice system in Tennessee, there is no corresponding stop-payment-notice release bond. The closest analog is the lien discharge bond under T.C.A. § 66-11-142, which allows any person to record a surety bond equal to the claimed lien amount to discharge a recorded mechanic's lien, after which the claimant pursues the surety rather than the property.

Commercial bondRequired by state law

Tennessee Notary Bond

Tennessee notaries must secure a $10,000 bond under T.C.A. 8-16-104. The bond is from a surety company licensed in Tennessee, or from two or more personal sureties approved by the county legislative body, and is filed with the county clerk.

Federal bondFrom $2,250/yrRequired by federal law

Tennessee Freight Broker Bond (BMC-84)

Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
