Alabama Bid Bond
Alabama requires a bid guarantee on public works bids under Ala. Code § 39-2-4. It is at least 5 percent of the estimated cost or the bid, capped at $10,000, or $50,000 when the awarding authority is the Department of Transportation.
Alabama Performance & Payment Bond
Alabama's public works bond law, Ala. Code § 39-1-1, requires a performance bond of 100 percent and a payment bond of at least 50 percent of the contract price. Since September 1, 2023 it applies to public works contracts of $100,000 or more.
Alabama Contractor License Bond
Alabama has no statewide general contractor license bond; the Licensing Board for General Contractors qualifies contractors by net worth and financial statements. Some Alabama cities require a contractor license bond to work locally.
Alabama Mechanic's Lien Discharge Bond
In Alabama, a person with an interest in the property can transfer a mechanics lien from the property to a bond filed with the court under Ala. Code § 35-11-233(b). The bond equals the lien amount plus 8 percent yearly interest for three years, plus $100 for court costs.
Alabama Subdivision Bond
Alabama planning commissions set subdivision rules under Title 11, Chapter 52, Article 2 of the Code of Alabama. Some let developers post security instead of finishing improvements before the plat is signed.
Alabama Maintenance Bond
No Alabama statute requires maintenance or warranty bonds. Ala. Code § 39-1-1 requires a 100% performance bond and a payment bond of at least 50% on public works contracts of $100,000 or more, but does not mention maintenance bonds, so they are set by the contract or local rules.
Alabama Right-of-Way Bond
The Alabama Department of Transportation requires permits for work on state highway right-of-way and uses bond forms for permit work, including Form BM-175, a highway occupancy permit blanket bond.
Alabama Permit Bond
Alabama cities and counties set their own permit bond rules for building, street and other work permits.
Alabama Supply Bond
For state purchases under Alabama's competitive bid law, Ala. Code § 41-16-28 provides that a bond for faithful performance of the contract, with adequate surety, shall be required in an amount specified in the advertisement for bids. The buying agency sets the amount; for local agencies covered by § 41-16-58, a performance bond may be required.
Alabama Stop Payment Notice Release Bond
Alabama's mechanics lien law has no stop payment notice procedure, so no stop notice release bond is used. Liens on property are released with a bond under Ala. Code § 35-11-233.
Alabama Notary Bond
Alabama notaries must give a $50,000 bond payable to the State of Alabama under Ala. Code § 36-20-71, raised from $25,000 by the 2023 revised notary act. Notaries are commissioned by the county judge of probate for four years.
Alabama Freight Broker Bond (BMC-84)
Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
