New Hampshire Bid Bond
No New Hampshire statute sets a general bid bond requirement. The project owner sets bid security in the bid documents; New Hampshire DOT invitations for bids commonly require a bid bond of 5% of the bid amount.
New Hampshire Performance & Payment Bond
New Hampshire's little Miller Act, RSA 447:16, requires a bond on state and political subdivision construction contracts over $35,000, conditioned on payment of laborers and subcontractors. Whether the statute also requires a separate performance bond is not clear from its text.
New Hampshire Contractor License Bond
New Hampshire does not license general or home improvement contractors at the state level, so there is no state contractor license bond. Electricians, plumbers and gas fitters are licensed as individuals by the Office of Professional Licensure and Certification without a contractor bond.
New Hampshire Mechanic's Lien Discharge Bond
In New Hampshire a mechanic's lien is secured by attaching the property in a court action (RSA 447:10). The owner can petition the court to release a real estate attachment, and the court may require a bond with sureties to pay any judgment the claimant wins (RSA 511:48).
New Hampshire Subdivision Bond
New Hampshire planning boards set subdivision security in their subdivision regulations under RSA 674:36, III. Instead of building streets and utilities before final approval, the board must accept a performance bond, letter of credit or other security named in its regulations, and must release it in part as work is completed.
New Hampshire Maintenance Bond
No New Hampshire statute requires a maintenance bond in general. The state public works bond law, RSA 447:16, requires only a payment bond of at least 100% of the contract price; a maintenance or warranty bond comes from the contract or local conditions.
New Hampshire Right-of-Way Bond
Under RSA 236:10, the authority that permits excavation in a highway may require a bond to the state, city or town for satisfactory restoration of the highway. The New Hampshire Department of Transportation permits work in state highway right-of-way.
New Hampshire Permit Bond
New Hampshire towns and cities set permit bonds. RSA 236:10 lets the authority that permits excavation in a highway require a bond, and towns set their own amounts; for example, Salem requires a permit bond or letter of credit of at least $5,000 for street excavation permits.
New Hampshire Supply Bond
No New Hampshire statute requires supply bonds. The state bond law for public works, RSA 447:16, covers payment for labor, materials and equipment on construction contracts; a bond on a supply contract is set by the buyer.
New Hampshire Stop Payment Notice Release Bond
New Hampshire has no stop payment notice procedure. Unpaid subcontractors and suppliers use mechanic's liens on private jobs and the RSA 447:16 payment bond on public works, so there is no stop notice release bond.
New Hampshire Notary Bond
New Hampshire does not require a notary public to post a bond. Notaries are appointed by the Governor with the consent of the Executive Council for a five-year term under RSA 455:1.
New Hampshire Freight Broker Bond (BMC-84)
Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
