Utah Performance & Payment Bond

Utah requires a performance bond and a payment bond, each equal to 100% of the contract price, on public construction contracts of the state and its political subdivisions.

Utah Contractor License Bond

Utah contractors must show financial responsibility to the Division of Professional Licensing. A license bond is required only in some cases, such as a recent bankruptcy or unpaid debts.

Utah Mechanic's Lien Discharge Bond

In Utah, an owner or contractor can release a construction lien from the property by recording a notice of release with a surety bond or cash deposit as substitute security.

Development bond3%, $250 minSet by cities and counties

Utah Subdivision Bond

Utah cities and counties may accept an improvement completion assurance, such as a bond, so a developer can record a plat before required public improvements are finished. State land use law sets the limits.

Contract bondRequired by state law

Utah Maintenance Bond

UDOT requires a Performance and Warranty Bond for encroachment permits in state highway right of way, and the bond must stay in effect for 3 years after the work is completed. For subdivision improvements, Utah Code § 10-9a-604.5 lets a city require an improvement warranty before accepting the improvements, with security capped at 10% of the improvement cost. On other jobs, the contract sets any maintenance bond.

Permit bondRequired by state law

Utah Right-of-Way Bond

UDOT requires an encroachment permit for work in state highway right of way, and applicants must provide a performance and warranty bond.

Permit bondSet by cities and counties

Utah Permit Bond

Utah has no statewide building permit bond; cities and counties set their own. For example, Salt Lake City requires contractors doing excavation in the public way to post a bond, with a standard amount of $15,000, along with a Utah contractor's license and insurance.

Contract bondSet by the contract

Utah Supply Bond

Utah does not require supply bonds by statute. Under Utah Admin. Code R33-111-302, a state procurement official may require a surety or performance bond on a non-construction contract, but only if the solicitation says so and states the amount and the work covered.

Utah Stop Payment Notice Release Bond

Utah has no stop payment notice procedure. Unpaid parties on public jobs claim against the payment bond required by Utah Code § 14-1-18 and § 63G-6a-1103, and on private jobs use a preconstruction or construction lien.

Commercial bondRequired by state law

Utah Notary Bond

Utah notaries must file a $5,000 notarial bond that runs for the 4-year commission term. The Lieutenant Governor's office commissions notaries.

Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
