Michigan Bid Bond
Michigan has no general statute setting a bid bond amount. The Michigan Department of Transportation's Standard Specifications for Construction require a bid guaranty on its contracts, and many Michigan counties and cities that use those specifications ask for a bid bond or certified check, often 5% of the bid.
Michigan Performance & Payment Bond
Michigan's public works bond act (1963 PA 213) requires a performance bond and a payment bond before a public building or public works contract over $50,000 is awarded.
Michigan Contractor License Bond
Michigan licenses residential builders and maintenance and alteration contractors through the Department of Licensing and Regulatory Affairs (LARA). The state license requires 60 hours of prelicensure education and an exam, but no surety bond.
Michigan Mechanic's Lien Discharge Bond
Under the Michigan Construction Lien Act, a bond in twice the amount of the lien can be filed with the county clerk to substitute for the lien on the property.
Michigan Subdivision Bond
Under Michigan's Land Division Act, a city, village or township may require the developer to finish required street and other improvements, or to post a deposit such as a surety bond, before it approves a final plat. The local government sets the amount, which must be enough to make sure the work is finished on time.
Michigan Maintenance Bond
Michigan's public works bond law requires performance and payment bonds on public construction contracts over $50,000, but not a maintenance bond. When a maintenance or warranty bond is used, the owner's contract or local development rules set the amount and period.
Michigan Right-of-Way Bond
In Michigan, county road commissions and cities often require a bond before work in the road right of way. MDOT issues construction permits for state trunklines through its Permit Gateway.
Michigan Permit Bond
Michigan has no general statewide permit bond. Under MCL 125.3505, a local government may require a performance guarantee, such as a surety bond, to make sure work under a zoning permit meets the ordinance and its conditions. The amount covers the estimated cost of the improvements and is due when the permit is issued.
Michigan Supply Bond
Michigan's public works bond law covers contracts for building, altering or repairing public buildings and works over $50,000. It does not require bonds on contracts to supply goods. When a supply bond is used, the buyer's contract sets it.
Michigan Stop Payment Notice Release Bond
Michigan does not use a stop payment notice procedure. Unpaid contractors, subcontractors and suppliers use construction liens under the Construction Lien Act, and a lien can be discharged by filing a bond of twice the lien amount with the county clerk (MCL 570.1116).
Michigan Notary Bond
Michigan notary applicants must get a $10,000 surety bond and file it with the county clerk before applying to the Secretary of State.
Michigan Freight Broker Bond (BMC-84)
Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
