Pennsylvania Bid Bond
Under the Commonwealth Procurement Code, state agencies may require bid security on construction contracts. The amount is the minimum amount or percentage set in the bid documents.
Pennsylvania Performance & Payment Bond
Pennsylvania has two laws: the Commonwealth Procurement Code for state agency projects, and the Public Works Contractors' Bond Law of 1967 for other public bodies. Both require 100% performance and 100% payment bonds above set contract values.
Pennsylvania Contractor License Bond
Pennsylvania has no statewide contractor license bond. Home improvement contractors register with the Office of Attorney General under the Home Improvement Consumer Protection Act, which requires insurance, not a bond.
Pennsylvania Mechanic's Lien Discharge Bond
Under the Mechanics' Lien Law of 1963, an owner can discharge a lien by depositing money in court or by filing a bond. The bond is double the required deposit, or a lower amount the court approves.
Pennsylvania Subdivision Bond
Pennsylvania municipalities require financial security for subdivision and land development improvements under Section 509 of the Municipalities Planning Code. The usual amount is 110% of the cost of completing the improvements.
Pennsylvania Maintenance Bond
After a municipality accepts subdivision improvements, it may require maintenance security for up to 18 months, capped at 15% of the cost of the improvements. On other projects a maintenance bond is set by contract.
Pennsylvania Right-of-Way Bond
PennDOT may require a bond or other security before issuing a permit for utility work in a state highway when the work is substantial. The security guarantees restoration and upkeep of the highway.
Pennsylvania Permit Bond
Pennsylvania has no statewide statute requiring a permit bond as a condition of issuing building or work permits. Local governments set their own requirements under their general licensing powers. Philadelphia, for example, mandates a $100,000 surety bond under Philadelphia Code § 9-1009 for all excavation contractor licenses—a prerequisite for pulling excavation site permits—with the City's Department of Licenses and Inspections as the obligee.
Pennsylvania Supply Bond
Pennsylvania's Commonwealth Procurement Code, 62 Pa.C.S. § 533, gives contracting officers discretionary authority to require bid security and performance bonds on supply and service contracts—the statute uses 'may be required,' not 'shall.' The Public Works Contractors' Bond Law of 1967 (8 P.S. § 193) mandates 100% performance and payment bonds on public works construction contracts over $5,000, but that law is expressly limited to construction, reconstruction, alteration, or repair of public buildings and public works, not standalone supply contracts.
Pennsylvania Stop Payment Notice Release Bond
Pennsylvania does not have a stop payment notice procedure, so there is no bond to release one.
Pennsylvania Notary Bond
Pennsylvania notaries must keep a $10,000 bond on file with the Department of State for their 4-year commission.
Pennsylvania Freight Broker Bond (BMC-84)
Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
