Ohio Bid Bond
Ohio requires every bidder on a state or political subdivision public improvement contract to file a bid guaranty with the bid, under R.C. 153.54. It is either a bond for the full amount of the bid or a check or letter of credit for 10 percent.
Ohio Performance & Payment Bond
Ohio requires performance and payment bonds on public improvement contracts. On state projects each bond equals 100 percent of the contract sum.
Ohio Contractor License Bond
Ohio has no general statewide contractor license bond. Cities set their own bond rules; for example, Cleveland requires bonds for some contractor license classes.
Ohio Mechanic's Lien Discharge Bond
In Ohio, a surety bond can replace a mechanic's lien as security under R.C. 1311.11. The bond is double the claim, or one and one-half times the claim if the claim is over $5,000.
Ohio Subdivision Bond
Ohio cities, villages and counties require performance bonds or other security for subdivision improvements under their own subdivision regulations.
Ohio Maintenance Bond
Ohio has no single statewide statute mandating a standalone maintenance bond across all public construction. For ODOT highway projects, Supplemental Specification 882 (enabled by Ohio Rev. Code § 5525.25) requires a separate two-year maintenance bond equal to 75% of the warranty item bid for chip-seal pavement; for other state and local public projects under Ohio Rev. Code § 153.54, defective-work coverage is addressed through the performance bond or added by the project owner as a separate contract requirement. Ohio Admin. Code Rule 122:15-1-01 limits surety-guaranteed maintenance agreements to two years (defective workmanship or materials only) without Development Services Agency approval.
Ohio Right-of-Way Bond
ODOT requires a permit bond for contractors working in state highway right of way. Permits are issued under R.C. 5515.01 and 5515.02. Cities also set their own right-of-way permit bonds.
Ohio Permit Bond
Permit bonds in Ohio are set by cities and counties, for example for right-of-way work.
Ohio Supply Bond
Ohio has no statute that specifically creates or mandates a 'supply bond' as a named instrument. Ohio Rev. Code § 9.311 requires bids for public contracts to supply materials or render services to be accompanied by performance bonds, payment bonds, or a combination thereof executed by a licensed Ohio surety, but the statute does not label these 'supply bonds.' Material suppliers on public improvement contracts are protected through the payment bond required by Ohio Rev. Code § 153.54; on private or supply-only contracts, a supply bond may be required by the project owner's contract.
Ohio Stop Payment Notice Release Bond
Ohio has a statutory equivalent for public improvement contracts: under Ohio Rev. Code § 1311.26, an unpaid subcontractor or material supplier may file a sworn affidavit with the public authority within 120 days of last furnishing labor or materials, which triggers a mandatory fund withholding by the authority under Ohio Rev. Code § 1311.28. The prime contractor or any interested party may then discharge that lien and free the withheld funds by posting a surety bond equal to 150% of the claimed amount with the public authority under Ohio Rev. Code § 1311.311. Ohio does not use the term 'stop payment notice'; this mechanism applies only to public improvement contracts, not to private construction or construction lenders.
Ohio Notary Bond
Ohio does not require a notary public to file a surety bond. The Secretary of State commissions notaries for five years under R.C. Chapter 147.
Ohio Freight Broker Bond (BMC-84)
Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
