Contract bondFreeRequired by state law

Kentucky Bid Bond

Kentucky requires bidder's security on construction contracts that a local public agency estimates will exceed $100,000. Under KRS 45A.430 the security must be at least five percent of the amount of the bid.

Kentucky Performance & Payment Bond

Kentucky requires performance and payment bonds on construction contracts over $100,000 under KRS 45A.435. Each bond is 100 percent of the contract price. The threshold rose from $25,000 in 2019.

License bondSet by cities and counties

Kentucky Contractor License Bond

Kentucky has no statewide general contractor license or license bond. The state licenses trades such as electrical contractors under KRS chapter 227A, which requires proof of insurance, while cities and counties set their own contractor license and bond rules; Louisville Metro, for example, uses a License and/or Permit Bond payable to its Office of Construction Review.

Court and release bondRequired by state law

Kentucky Mechanic's Lien Discharge Bond

In Kentucky, a property owner, contractor or subcontractor can file a bond with the county clerk to discharge a recorded mechanic's lien under KRS 376.100. The bond is for twice the amount of the lien.

Kentucky Subdivision Bond

Under KRS 100.281, each Kentucky planning unit's subdivision regulations must state the physical improvements a developer must install or dedicate and when, along with the surety required to guarantee completion. The local planning commission, or the fiscal court in counties without planning, sets the amount.

Contract bondSet by the contract

Kentucky Maintenance Bond

No Kentucky statute requires maintenance or warranty bonds. KRS 45A.190 requires performance and payment bonds on state construction contracts over $100,000, but not maintenance bonds, so these are set by the contract or by local subdivision regulations.

Permit bondRequired by state law

Kentucky Right-of-Way Bond

The Kentucky Transportation Cabinet requires an encroachment permit bond for work in state highway right-of-way. The permittee gives a performance bond under the Department of Highways Permits Manual, and a payment bond may be required at the department's discretion.

Permit bondSet by cities and counties

Kentucky Permit Bond

Kentucky has no statewide permit bond. Cities and counties set their own; Louisville Metro, for example, requires a License and/or Permit Bond payable to its Office of Construction Review for certain permits, guaranteeing the permit holder follows the laws and ordinances that apply.

Contract bondSet by the contract

Kentucky Supply Bond

Kentucky does not require supply bonds by statute. Under KRS 45A.190, for state contracts other than construction over $100,000, the agency's contract administrator decides whether a performance bond is needed, so a supply bond applies only when the solicitation or contract requires it.

Court and release bondRequired by state law

Kentucky Stop Payment Notice Release Bond

On Kentucky public projects, an unpaid party can file a lien on the public funds owed to the contractor under KRS 376.210, and the public authority must withhold that amount under KRS 376.250. Under KRS 376.212, the contractor can discharge the lien by filing a bond for double the amount claimed with the county clerk.

Commercial bondRequired by state law

Kentucky Notary Bond

A Kentucky notary public must file a $1,000 surety bond under KRS 423.390. The commission term is four years and the Secretary of State appoints notaries.

Federal bondFrom $2,250/yrRequired by federal law

Kentucky Freight Broker Bond (BMC-84)

Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
