Kansas Bid Bond

Kansas has no general statute that requires bid bonds on public works. The bid documents set bid security, often 5% of the bid. One exception: K.S.A. 68-704 requires a bid surety equal to 5% of the bid on county road improvements let under that section.

Kansas Performance & Payment Bond

Kansas requires a payment bond on public improvement contracts over $100,000 under K.S.A. 60-1111. The bond must be at least the total contract sum and covers labor, materials, equipment and supplies.

License bondSet by cities and counties

Kansas Contractor License Bond

Kansas has no statewide general contractor license or license bond. Roofing contractors register with the Attorney General under the Kansas Roofing Registration Act. Cities and counties run their own contractor licensing and decide whether a bond is needed.

Court and release bondRequired by state law

Kansas Mechanic's Lien Discharge Bond

A Kansas owner or contractor can post a bond to discharge mechanic's liens under K.S.A. 60-1110. The bond must be approved by a district court judge and filed with the clerk of the district court.

Kansas Subdivision Bond

Under K.S.A. 12-749, a Kansas city or county's subdivision regulations may let a developer post a corporate surety bond, cashier's check, escrow, letter of credit or similar security instead of finishing the improvements before final plat approval. The governing body sets the amount and the completion period.

Kansas Maintenance Bond

Kansas public works bond laws do not require a maintenance bond. K.S.A. 60-1111 requires a payment bond on public improvements over $100,000, and K.S.A. 68-410 requires a performance and payment bond on state highway contracts. Any maintenance or warranty bond is set by the contract or the local agency.

Permit bondSet by cities and counties

Kansas Right-of-Way Bond

Kansas cities set right-of-way bond rules for work in city streets. K.S.A. 17-1902 lets a city require a performance bond from a telecommunications provider building or maintaining facilities in the public right-of-way, in a form the city accepts.

Permit bondSet by cities and counties

Kansas Permit Bond

Kansas has no statewide permit bond. Cities set their own, for example for moving buildings: Lawrence requires a $10,000 bond and Junction City requires a $1,000 surety bond plus a $5,000 mover's bond.

Kansas Supply Bond

No Kansas statute requires supply bonds. The public works bond law, K.S.A. 60-1111, covers contracts for public improvements, not supply purchases. When used, a supply bond is set by the buyer in the contract.

Court and release bondNot used in this state

Kansas Stop Payment Notice Release Bond

Kansas lien law (K.S.A. 60-1101 to 60-1112) has no stop payment notice procedure, so this bond is not used. Instead, an owner or contractor can file a bond under K.S.A. 60-1110 to discharge mechanic's liens.

Commercial bondRequired by state law

Kansas Notary Bond

A Kansas notary public must have a $12,000 surety bond under K.S.A. 53-5a22. The commission term is four years and the Secretary of State commissions notaries.

Federal bondFrom $2,250/yrRequired by federal law

Kansas Freight Broker Bond (BMC-84)

Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
