Georgia Performance & Payment Bond

Georgia's Little Miller Act requires performance and payment bonds on public works contracts, each for at least the total contract amount. House Bill 137 raised the threshold from $100,000 to $250,000 effective July 1, 2025.

License bondRequired by state law

Georgia residential-basic and residential-light commercial contractors must show financial responsibility, and the State Licensing Board for Residential and General Contractors lets them do it with a $25,000 bond. General contractors are not required to post a bond.

Georgia Mechanic's Lien Discharge Bond

In Georgia, an owner or contractor can discharge a recorded lien by filing a bond approved by the clerk of superior court under O.C.G.A. § 44-14-364. The bond pays the lien holder what is found due in a lien action brought within 365 days of filing the claim.

Georgia Subdivision Bond

Georgia has no statewide subdivision bond amount. Cities and counties set it in their subdivision regulations. For example, the City of Marietta accepts a performance bond of at least 110% of the estimated cost of the improvements, and requires a 12-month maintenance bond of 10% of the improvement cost when the final plat is submitted.

Georgia Maintenance Bond

No Georgia statute sets a general maintenance bond for construction contracts; on public works, the owner's contract sets it. Cities and counties require maintenance bonds on subdivision improvements they will take over. For example, Marietta requires a 12-month maintenance bond of 10% of the improvement cost at final plat.

Permit bondRequired by state law

Georgia Right-of-Way Bond

The Georgia Department of Transportation requires a performance bond or letter of escrow for driveway and encroachment permits on state highways. The amount is based on the Department's estimated construction cost for the work, and blanket bonds are accepted. Cities and counties set their own rules for local streets.

Georgia Permit Bond

Georgia has no general statewide permit bond. Cities and counties set permit bonds. Under the Georgia Erosion and Sedimentation Act, a local issuing authority may require a bond of up to $3,000 per acre before issuing a land-disturbing permit; Snellville, for example, requires one for sites disturbing 5 acres or more.

Georgia Supply Bond

Georgia law requires payment and performance bonds on state construction contracts over $100,000, but not on supply contracts. Under the Georgia Procurement Manual, a state entity may require bonds on non-construction contracts, and the solicitation states the bond and amount.
