Oregon Bid Bond

Oregon contracting agencies must require bid security on public improvement contracts over $100,000, or over $50,000 for highways, bridges and other transportation projects, under ORS 279C.365. The model rules set bid security at 5 to 10 percent of the bid.

Oregon Performance & Payment Bond

Oregon requires a performance bond and a payment bond, each for the full contract price, on public improvement contracts over $100,000 (over $50,000 for transportation projects), under ORS 279C.380.

License bondRequired by state law

Oregon Contractor License Bond

Oregon requires a surety bond for contractors licensed by the Construction Contractors Board under ORS 701.068. For residential contractors the amounts depend on the license type.

Court and release bondRequired by state law

Oregon Mechanic's Lien Discharge Bond

In Oregon, an owner or interested person can file a bond with the recording officer to release a construction lien under ORS 87.076. The bond is at least 150 percent of the amount claimed, or $1,000, whichever is greater.

Development bond3%, $250 minSet by cities and counties

Oregon Subdivision Bond

Oregon cities and counties approve subdivision plats and set improvement security. Under ORS 92.090, a plat can be approved before the water supply or sewage system is installed if the subdivider gives the city or county a bond, irrevocable letter of credit, contract or other assurance, in an amount set by a registered professional engineer.

Contract bondSet by the contract

Oregon Maintenance Bond

Oregon's public improvement bond law, ORS 279C.380, requires a performance bond and a payment bond, each equal to the contract price, but no separate maintenance bond. A maintenance or warranty bond is set by the contract or the local agency; for example, Portland City Code 17.24.012 lets the city require a maintenance bond from right-of-way permittees.

Permit bondRequired by state law

Oregon Right-of-Way Bond

For utility work on state highways, the Oregon Department of Transportation can require a bond or cash deposit under OAR 734-055-0035, in the amount set in the permit's special provisions. Work can't start until the bond is approved. Cities set their own rules for city streets; Portland requires a street opening bond under City Code 17.32.040.

Oregon Permit Bond

Oregon has no statewide general permit bond. Cities set their own; for example, Portland requires an approved street opening bond before it issues a street opening or sewer connection permit (City Code 17.32.040).

Oregon Supply Bond

No Oregon statute requires supply bonds. ORS 279C.380 requires performance and payment bonds on public improvement contracts, not on purchases of goods. When used, a supply bond is set by the buyer in the solicitation or contract.

Oregon Stop Payment Notice Release Bond

Oregon's construction lien law (ORS 87.001 to 87.093) has no stop payment notice procedure, so this bond is not used. Instead, an owner or interested person can release a construction lien with a bond or deposit of at least 150% of the claim or $1,000, whichever is greater, under ORS 87.076.

Oregon Freight Broker Bond (BMC-84)

Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
