Oklahoma Bid Bond
Oklahoma's Public Competitive Bidding Act requires a bid guaranty of 5 percent of the bid on public construction contracts over $100,000. It can be a certified check, cashier's check or bid bond.
Oklahoma Performance & Payment Bond
Before an award over $100,000 for public construction in Oklahoma, the contractor must furnish a bond payable to the state, in a sum not less than the total contract sum, under 61 O.S. § 1. The bond covers labor, materials and equipment.
Oklahoma Contractor License Bond
Oklahoma requires active electrical, plumbing and mechanical contractors to carry a $5,000 surety bond payable to the Construction Industries Board. Other contractor trades have no statewide license bond.
Oklahoma Mechanic's Lien Discharge Bond
In Oklahoma, a lien can be discharged by depositing a surety bond or cash with the county clerk equal to 125 percent of the lien claim. The claimant then has 10 days to object.
Oklahoma Subdivision Bond
Oklahoma cities and counties require a bond for subdivision improvements under their subdivision regulations. A typical rule asks for a surety bond to complete the improvements within 12 months of final plat approval.
Oklahoma Maintenance Bond
Oklahoma has no general statute for maintenance bonds. They are set by the contract or by local subdivision rules, where a one-year maintenance bond after improvements are accepted is common.
Oklahoma Right-of-Way Bond
The Oklahoma Department of Transportation requires a permit for utility work in its right of way and may require a bond or other indemnification at its discretion. Under Title 730 of the Oklahoma Administrative Code, the District Engineer decides the need and amount.
Oklahoma Permit Bond
Oklahoma has no statewide statute requiring a surety bond as a precondition for issuing a building or work permit. Cities and counties set their own permit-bond requirements by ordinance. For example, Tulsa requires a $5,000 Temporary Use of Streets Bond under Tulsa Rev. Ord. Title 11, Ch. 12, § 1211 for minor right-of-way construction work, while Oklahoma City requires a Right of Way Permit Bond (ranging from $10,000 to $250,000 depending on work scope) for projects affecting public rights of way.
Oklahoma Supply Bond
Oklahoma's Little Miller Act (61 O.S. § 1) requires a bond equal to the full contract price for public construction and repair contracts exceeding $100,000, and that bond expressly protects material suppliers within those construction contracts. However, the statute applies only to 'construction or repair' of public buildings or improvements—not to stand-alone supply-only contracts. No Oklahoma statute mandates a separate supply bond for a procurement contract that covers materials or equipment alone; whether such a bond is required depends on the individual agency's solicitation or contract documents.
Oklahoma Stop Payment Notice Release Bond
Oklahoma does not have a stop payment notice (stop notice) statute. Unpaid subcontractors and material suppliers in Oklahoma rely on mechanics and materialmen's liens under 42 O.S. §§ 141–152 as their primary statutory payment remedy, not stop payment notices served on lenders. Because no stop payment notice mechanism exists in Oklahoma law, there is no corresponding stop payment notice release bond.
Oklahoma Notary Bond
Oklahoma notaries must file a $1,000 bond with the Secretary of State before starting their duties, and not more than 60 days after the commission is issued. The commission lasts four years.
Oklahoma Freight Broker Bond (BMC-84)
Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
