Contract bondFreeRequired by state law

Arkansas Bid Bond

Arkansas state agency construction bids over the amount set in Ark. Code § 22-9-203 are void unless they come with a cashier's check or corporate bid bond. State bid documents set the security at five percent of the bid.

Contract bond3%, $250 minRequired by state law

Arkansas Performance & Payment Bond

Arkansas requires a bond equal to the contract amount on public improvement contracts over $20,000. The bond must cover claims for labor and materials under Ark. Code § 22-9-401 and following.

License bondRequired by state law

Arkansas Contractor License Bond

Arkansas does not require a flat license bond from every contractor. Under Ark. Code § 17-25-304(c), an applicant may give a surety bond to the Contractors Licensing Board instead of a financial statement showing minimum net worth. The bond is ten times the required net worth for the license classification.

Court and release bondRequired by state law

Arkansas Mechanic's Lien Discharge Bond

Under Ark. Code § 18-44-118, a person liable for a mechanic's lien can file a bond with the circuit clerk to contest it. The bond amount was not confirmed from the statute text.

Development bond3%, $250 minSet by cities and counties

Arkansas Subdivision Bond

Arkansas cities set subdivision improvement rules in their land development regulations. Ark. Code § 14-56-417 lets those regulations allow a developer to post a performance bond instead of installing required improvements before plat approval; the city or its planning commission sets the amount.

Contract bondSet by the contract

Arkansas Maintenance Bond

No Arkansas statute requires maintenance or warranty bonds. The state's public construction bidding law, Ark. Code § 19-4-1405, calls for bid security and completion bonds but not maintenance bonds, so maintenance bonds are set by the contract or by local subdivision rules.

Permit bondRequired by state law

Arkansas Right-of-Way Bond

Ark. Code § 27-67-218 makes it unlawful to dig up or disturb a state highway except as authorized by the State Highway Commission. ARDOT uses a bond to guarantee satisfactory restoration of the highway right of way, payable to the State of Arkansas, for permit holders working in state highway right of way.

Permit bondSet by cities and counties

Arkansas Permit Bond

Arkansas has no statewide permit bond. Cities set their own rules; for example, a 2018 Little Rock street cut ordinance requires a surety bond, in an amount the City Manager sets, before a permit to excavate, cut or bore in the public right of way is issued.

Contract bondSet by the contract

Arkansas Supply Bond

Under Ark. Code § 19-11-235(c), the State Procurement Director or an agency procurement official may require a bid bond, performance bond or similar assurance from bidders and contractors. The state procurement rule caps such a bond at 100% of the contract price, and it applies only when the solicitation requires it.

Court and release bondNot used in this state

Arkansas Stop Payment Notice Release Bond

Arkansas has no stop payment notice procedure. Unpaid parties on private jobs use mechanic's and materialmen's liens under Ark. Code §§ 18-44-101 to 18-44-135, and on public jobs they claim against the payment bond.

Commercial bondRequired by state law

Arkansas Notary Bond

Arkansas notaries must have a $7,500 surety bond before the Secretary of State commissions them. The commission term is 10 years.

Federal bondFrom $2,250/yrRequired by federal law

Arkansas Freight Broker Bond (BMC-84)

Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
