Missouri Performance & Payment Bond

Missouri public entities must require a payment bond from contractors on public works projects estimated to cost more than $50,000, under Section 107.170, RSMo. The public entity sets the bond amount.

License bondSet by cities and counties

Missouri Contractor License Bond

Missouri has no statewide general contractor license, so there is no state contractor license bond. Some cities and counties license contractors and may require a bond.

Court and release bondRequired by state law

Missouri Mechanic's Lien Discharge Bond

For residential real property, RSMo § 429.016 lets the owner or another interested person release a mechanic's lien by depositing substitute collateral with the circuit court, including a surety bond of at least 150% of the lien amount. The lien claim then moves from the property to the bond.

Development bond3%, $250 minSet by cities and counties

Missouri Subdivision Bond

Missouri cities may let a developer post a surety bond, escrow or letter of credit in place of finishing subdivision improvements before final plat approval, under Section 89.410, RSMo.

Contract bondSet by the contract

Missouri Maintenance Bond

Missouri's public works bond law, RSMo § 107.170, requires a bond securing payment for labor and materials on public works estimated to cost more than $50,000. It does not require a maintenance bond, so any maintenance or warranty bond is set by the contract or project owner.

Permit bondRequired by state law

Missouri Right-of-Way Bond

MoDOT requires a permit for work on its right of way and may require a bond or surety deposit, held until the work is completed and accepted.

Permit bondSet by cities and counties

Missouri Permit Bond

Missouri has no statewide general permit bond. Cities set their own; for example, Byrnes Mill requires a $2,000 bond for demolishing a structure under 1,500 square feet and $4,000 for a larger one, refunded after a clean final inspection.

Contract bondSet by the contract

Missouri Supply Bond

No Missouri statute requires a supply bond. RSMo § 107.170 requires a payment bond on public works over $50,000, which protects material suppliers but is not a supply bond. When used, a supply bond is set by the buyer in the contract.

Court and release bondNot used in this state

Missouri Stop Payment Notice Release Bond

Missouri's mechanic's lien law (RSMo chapter 429) has no stop payment notice procedure, so this bond is not used. On residential property, a lien can instead be released by depositing a bond of at least 150% of the lien under RSMo § 429.016.

Commercial bondRequired by state law

Missouri Notary Bond

Missouri notaries must file a $10,000 surety bond that runs for the same four-year term as the commission. The bond is filed with the county clerk and sent to the Secretary of State.

Federal bondFrom $2,250/yrRequired by federal law

Missouri Freight Broker Bond (BMC-84)

Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
