South Dakota Mechanic's Lien Discharge Bond

South Dakota's mechanics lien law, SDCL chapter 44-9, has no procedure for posting a bond to discharge a lien. Instead, the owner, the owner's agent or the contractor can serve a written demand to sue; if the lien holder does not sue within 30 days, the lien is forfeited and the register of deeds cancels it on affidavit.

South Dakota Maintenance Bond

South Dakota's public improvement bond law, SDCL 5-21-1, requires surety of at least the contract price for faithful performance and payment of laborers and suppliers, but does not require a separate maintenance or warranty bond. When one is used, the contract or local government sets it.

South Dakota Right-of-Way Bond

SDDOT's utility permit rules for state highway right of way (ARSD 70:04:05) require the permittee to indemnify the department but do not require a bond. Cities set their own right-of-way bonds; for example, Sioux Falls requires right-of-way bonds filed with the City Engineer before a permit is issued, under § 96.241 of its city code.

South Dakota Permit Bond

South Dakota has no statewide permit bond. Cities and counties set any bond tied to a building or work permit; for example, Sioux Falls requires permit holders to provide bonding, as required by city code, before a right-of-way permit is released.

South Dakota Supply Bond

Under SDCL 5-21-1, a contractor who contracts to furnish material or labor for a public improvement in South Dakota must furnish surety of at least the contract price for faithful performance and prompt payment of its own suppliers. Supply contracts that are not for a public improvement are set by the buyer's contract.

South Dakota Stop Payment Notice Release Bond

In South Dakota, a supplier to a contractor can serve the owner a sworn account and notice of claim, and the owner must then withhold enough of the contract price to cover it (SDCL 44-9-10). The statute has no bond for releasing the withheld money; the contractor has 15 days to dispute the claim (SDCL 44-9-11).

South Dakota no longer requires a notary bond. House Bill 1133 (SL 2025, ch 90) removed the $5,000 surety bond from SDCL 18-1-2 and 18-1-3 effective July 1, 2025; notaries now file an oath and seal with the Secretary of State and serve 6-year terms.
