Texas Bid Bond
Texas has no single statewide bid bond rule. Counties may require a bid bond of five percent of the total contract price on public works or contracts over $100,000 under Local Government Code Section 262.032.
Texas Performance & Payment Bond
Texas requires performance and payment bonds on public work contracts under Government Code Chapter 2253. Both bonds are for the full amount of the contract.
Texas Contractor License Bond
Texas has no statewide general contractor license and no statewide contractor license bond. Some cities require a bond for certain trade permits, for example Houston for commercial driveway, sidewalk, and curb and gutter work.
Texas Mechanic's Lien Discharge Bond
In Texas, any person may file a bond to indemnify against a mechanic's lien under Property Code Sections 53.171 and 53.172. The bond is double the lien amount, with a different rule when the liens exceed $40,000.
Texas Subdivision Bond
Texas cities set subdivision improvement security. Local Government Code Section 212.073 lets a developer who contracts with the city for improvements give a performance bond for the contract price.
Texas Maintenance Bond
Maintenance or warranty bonds in Texas are normally set by the contract or project owner. No statewide statute was confirmed.
Texas Right-of-Way Bond
Texas cities and counties set bond rules for work in public rights of way. For example, the City of Houston requires a bond for a Commercial Driveway, Sidewalk, or Curb and Gutter Permit.
Texas Permit Bond
Texas cities and counties set permit bond rules. For example, the City of Houston requires a bond with its commercial driveway, sidewalk, and curb and gutter permit.
Texas Supply Bond
No Texas statute specifically requiring supply bonds was found. When used, they are set by the buyer or purchasing agency in the contract.
Texas Stop Payment Notice Release Bond
In a few states, an unpaid subcontractor or supplier can serve a stop payment notice (also called a stop notice) on the owner or construction lender, which then holds back money owed on the job.
Texas Notary Bond
Every Texas notary public must give a $10,000 bond with a surety company authorized to do business in Texas, approved by the Secretary of State. The term ends four years after the notary qualifies.
Texas Freight Broker Bond (BMC-84)
Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
