North Dakota Performance & Payment Bond

North Dakota Century Code section 48-01.2-10 requires a contractor bond on public improvement contracts over a set dollar threshold. The bond covers both performance of the contract and payment of labor, material and subcontractor claims.

License bondNot used in this state

North Dakota Contractor License Bond

North Dakota licenses contractors through the Secretary of State for jobs over $4,000 under N.D.C.C. ch. 43-07. Applicants must file a certificate of liability insurance and workers' compensation proof; the license law does not require a surety bond.

Court and release bondRequired by state law

North Dakota Mechanic's Lien Discharge Bond

In North Dakota, an owner can apply to the district court to discharge a construction lien by filing a bond of at least the lien amount. The bond guarantees payment of any amount the lien claimant recovers, plus costs.

Development bond3%, $250 minSet by cities and counties

North Dakota Subdivision Bond

North Dakota law lets counties (N.D.C.C. § 11-33.2-12) and cities (N.D.C.C. ch. 40-48) regulate subdivisions and the streets, sewers and water mains built in them. The state code sections reviewed do not set a subdivision bond; any improvement guarantee is set by the local subdivision rules.

Contract bondSet by the contract

North Dakota Maintenance Bond

North Dakota requires a bond of at least the contract price on public improvement contracts over $250,000, covering performance and payment of labor and material claims (N.D.C.C. § 48-01.2-10). The statute does not require a separate maintenance or warranty bond; when used, the contract sets it.

Permit bondSet by cities and counties

North Dakota Right-of-Way Bond

Utility work on North Dakota state highway right of way needs an NDDOT permit, with a certificate of insurance; a statewide bond was not confirmed. Cities set their own rules: Bismarck requires work in city right of way to be done by a city-approved licensed and bonded contractor.

Permit bondSet by cities and counties

North Dakota Permit Bond

North Dakota has no statewide permit bond. Cities set their own; for example, Bismarck requires contractors working in city right of way to be city-licensed and bonded, and its concrete contractor packet lists a $5,000 license/permit bond.

North Dakota Supply Bond

North Dakota's public improvement bond law (N.D.C.C. § 48-01.2-10) covers construction of public improvements over $250,000, not supply purchases. The state Supreme Court held that supplying aggregate to county stockpiles was not construction of a public improvement, so the bond law did not apply. Supply bonds are set by the purchase contract.

North Dakota Stop Payment Notice Release Bond

North Dakota has no stop payment notice procedure. Unpaid parties on private jobs use a construction lien under N.D.C.C. ch. 35-27, and on public jobs claim against the contractor's bond under N.D.C.C. § 48-01.2-10.

Commercial bondRequired by state law

North Dakota Notary Bond

North Dakota requires a $7,500 notary bond covering notarial acts during the commission. The Secretary of State commissions notaries for a four year term.

Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
