New York Performance & Payment Bond

New York State Finance Law § 137 requires a payment bond on public improvement contracts with the state, municipal corporations, public benefit corporations and commissions. State Finance Law § 136 requires a bond for completion of the work on contracts paid from state appropriations.

License bondSet by cities and counties

New York Contractor License Bond

New York does not issue a statewide general contractor license, so there is no statewide contractor license bond. Cities and counties set their own licensing and bond rules.

Court and release bondRequired by state law

New York Mechanic's Lien Discharge Bond

Under New York Lien Law § 19(4), a mechanic's lien can be discharged by filing a bond or undertaking equal to 110% of the lien. The bond pays any judgment on the lien.

New York Maintenance Bond

New York State Finance Law § 137 (the Little Miller Act) mandates performance and payment bonds for public works contracts above $100,000 but does not separately require a maintenance or warranty bond by statute. Maintenance bond obligations arise from individual project owners or contracting agencies writing them into contract documents, either as a standalone bond or as a warranty period obligation folded into the performance bond.

Permit bondRequired by state law

New York Right-of-Way Bond

New York Highway Law § 52 lets the Department of Transportation require deposits of money or bonds guaranteeing the work before it grants a permit to work in a state highway right of way.

Permit bondSet by cities and counties

New York Permit Bond

New York has no single statewide law requiring permit bonds for all building or work permits; each jurisdiction sets its own rules. NYC Department of Transportation requires surety permit bonds under 34 RCNY § 2-02 for any work in city streets, with amounts scaled by annual permit volume. Separately, NYSDOT requires performance security (surety bonds or letters of credit) for every highway work permit on a state right-of-way under 17 NYCRR Part 127.

New York Supply Bond

New York has no statute specifically requiring a supply bond (a bond posted by a supplier to guarantee delivery of materials). New York State Finance Law § 137 requires prime contractors on public works contracts above $100,000 to post a payment bond protecting subcontractors and material suppliers from nonpayment—this is a different instrument. A supply bond may be required by a public agency or project owner in individual supply contract documents but is not mandated by state law.

New York Stop Payment Notice Release Bond

New York does not have a statutory stop payment notice system. Only Alaska, Arizona, California, and Washington give unpaid parties a right to serve a stop payment notice on an owner or construction lender. New York protects unpaid subcontractors and suppliers through mechanics liens under Lien Law Article 2 (for private projects) and statutory trust fund obligations under Lien Law Article 3-A; there is no stop payment notice release bond in New York law.
