New Jersey Supply Bond

New Jersey has no statewide law mandating a supply bond on supply contracts. N.J.S.A. 40A:11-22 (Local Public Contracts Law) requires performance and payment bonds for public construction contracts exceeding $100,000 but makes bonding for non-construction supply contracts entirely discretionary—a contracting unit 'may' require a surety certificate for 'any other contract.' Public agencies that want a supply bond must include it in their bid documents and contract specifications.

New Jersey Stop Payment Notice Release Bond

New Jersey does not have a stop payment notice (stop notice) mechanism. Unpaid subcontractors and suppliers protect themselves through mechanics liens on private projects under the Construction Lien Law (N.J.S.A. 2A:44A-1 to -38) or bond claims on public projects under the Public Works Bond Act (N.J.S.A. 2A:44-143). There is no New Jersey statute authorizing a stop payment notice or a corresponding release bond.

New Jersey Notary Bond

New Jersey does not require a notary public to file a surety bond. The State Treasurer commissions notaries for five years.
