Massachusetts Bid Bond
Massachusetts requires a bid deposit of 5% of the bid on public building contracts bid under M.G.L. c. 149, § 44A, and on public works contracts under M.G.L. c. 30, § 39M.
Massachusetts Performance & Payment Bond
Massachusetts requires a payment bond of at least half the contract price on public works over $25,000, and a performance bond and payment bond each equal to the contract price for general contractors on public building contracts under c. 149, § 44A.
Massachusetts Contractor License Bond
Massachusetts registers home improvement contractors under M.G.L. c. 142A. Instead of a license bond, each registrant pays into the state Home Improvement Contractor Guaranty Fund when applying for registration.
Massachusetts Mechanic's Lien Discharge Bond
In Massachusetts, any person in interest can dissolve a mechanic's lien by recording a surety bond equal to the amount of the lien.
Massachusetts Subdivision Bond
Under the Massachusetts Subdivision Control Law, the town planning board must secure the building of ways and municipal services before it endorses a definitive plan, and a bond is one allowed method.
Massachusetts Maintenance Bond
Massachusetts public building law requires a performance bond and a payment bond, each for the full contract price, but does not require a separate maintenance or warranty bond. When one is used, the contract or project owner sets it.
Massachusetts Right-of-Way Bond
Work on a Massachusetts state highway needs a written permit from MassDOT under M.G.L. c. 81, § 21. MassDOT may require a bond to guarantee the work is done properly and to cover damage to the highway; the department sets the amount.
Massachusetts Permit Bond
Massachusetts has no statewide permit bond. Cities and towns set their own rules; for example, Brockton requires contractors doing work in public ways to hold a Public Works Construction License with a license and permit bond of at least $5,000.
Massachusetts Supply Bond
Massachusetts buys supplies under the Uniform Procurement Act, M.G.L. c. 30B, which does not set a statewide supply bond. When a buyer wants one, it is set in the bid or contract documents.
Massachusetts Stop Payment Notice Release Bond
Massachusetts has no stop payment notice procedure. Unpaid parties use a mechanic's lien under M.G.L. c. 254, which can be dissolved by recording a surety bond equal to the lien amount, or on public jobs a payment bond claim or a demand for direct payment.
Massachusetts Notary Bond
Massachusetts does not require notaries to file a bond. The Governor appoints notaries for a 7-year term under M.G.L. c. 222 and Executive Order 455.
Massachusetts Freight Broker Bond (BMC-84)
Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
