Florida Bid Bond
Florida Department of Transportation bids over $150,000 must come with a bid guaranty of five percent of the bid, under Fla. Stat. 337.11 and FDOT bid documents. Other public owners set their own bid security in the solicitation.
Florida Performance & Payment Bond
Florida requires a payment and performance bond from a contractor on a public building or public work, recorded in the county public records, under Fla. Stat. § 255.05. State contracts of $100,000 or less need no bond, and local contracts of $200,000 or less may be exempted.
Florida Contractor License Bond
Florida does not require a general license bond from most state-licensed contractors; applicants instead show financial responsibility, including a FICO credit score of 660 or higher (Fla. Admin. Code R. 61G4-15.006). A qualifier who relies on a financially responsible officer must provide that officer's $100,000 bond or letter of credit payable to the Construction Industry Licensing Board (Fla. Admin. Code R. 61G4-15.0021).
Florida Mechanic's Lien Discharge Bond
In Florida, a lien can be transferred to a bond filed with the clerk of court under Fla. Stat. § 713.24. The bond covers the lien amount, three years of interest, and a set amount for attorney fees and costs.
Florida Subdivision Bond
Florida counties and cities require a bond or other guarantee for subdivision improvements before a plat is recorded. Platting follows Chapter 177, Florida Statutes, and each local government sets the security amount.
Florida Maintenance Bond
Florida has no separate maintenance bond statute. The public works bond form in Fla. Stat. § 255.05(3) includes the contractor's guarantee of work and materials for the time specified in the contract, so the warranty period and any separate maintenance bond are set by the contract.
Florida Right-of-Way Bond
FDOT issues utility permits for state highway right of way under Fla. Admin. Code R. 14-46.001 and its Utility Accommodation Manual, which does not set a statewide permit bond. Cities and counties set bonds for their streets; for example, Miami Beach requires a $500 minimum sidewalk bond or security deposit for soil-boring permits.
Florida Permit Bond
Florida has no statewide permit bond. Cities and counties set their own; for example, Miami Beach sets a $500 minimum sidewalk bond or security deposit for some right-of-way permits, and Hillsborough County uses a Code Compliance Bond form for locally licensed contractors.
Florida Supply Bond
Florida's public works bond law, Fla. Stat. § 255.05, covers construction and repair of public buildings and works, not supply-only purchases. Supply bonds are set by the buying agency in the bid or contract.
Florida Stop Payment Notice Release Bond
Florida has no stop payment notice procedure. Unpaid parties use a construction lien under Fla. Stat. ch. 713, which can be transferred to a cash deposit or surety bond under Fla. Stat. § 713.24, or on public jobs a claim on the § 255.05 payment bond.
Florida Notary Bond
Florida notaries public must have a $7,500 bond approved and filed with the Department of State, under Fla. Stat. § 117.01. The commission term is four years.
Florida Freight Broker Bond (BMC-84)
Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
