Virginia Bid Bond
The Virginia Public Procurement Act requires a bid bond on larger public construction contracts funded in whole or part by the Commonwealth. The bond may not exceed 5% of the bid.
Virginia Performance & Payment Bond
Virginia requires a performance bond and a payment bond, each in the sum of the contract amount, on larger public construction contracts under the Virginia Public Procurement Act.
Virginia Contractor License Bond
Virginia Class A and Class B contractor applicants must show a minimum net worth, or instead file a $50,000 surety bond on the Board for Contractors' bond form.
Virginia Mechanic's Lien Discharge Bond
In Virginia, the owner, general contractor or another party in interest can ask the court to release a mechanic's lien from the property by posting a bond, either during an enforcement suit or before one is filed.
Virginia Subdivision Bond
Virginia law lets localities require a bond, letter of credit or other surety so a developer completes public improvements shown on an approved subdivision plat.
Virginia Maintenance Bond
No Virginia statute requires maintenance or warranty bonds. Va. Code § 2.2-4337 requires performance and payment bonds on public construction contracts over $500,000 (over $350,000 for state-funded transportation projects) but does not mention maintenance bonds, so they are set by the contract or project owner.
Virginia Right-of-Way Bond
VDOT requires surety for land use permits to work in state highway right of way. The amount depends on the type of permit and the cost of the work.
Virginia Permit Bond
Virginia has no statewide permit bond; each county, city or town sets its own. For example, under Va. Code § 62.1-44.15:57, a local agency issuing a grading, building or other permit for land-disturbing work may require a reasonable performance bond with surety, capped at the estimated cost of erosion and sediment control work plus up to 25% for administrative costs and inflation.
Virginia Supply Bond
No Virginia statute requires supply bonds. The Virginia Public Procurement Act's bond sections (Va. Code §§ 2.2-4336 and 2.2-4337) apply to construction contracts, so a bond on a supply contract is set by the solicitation or contract.
Virginia Stop Payment Notice Release Bond
Virginia has no stop notice procedure. Its mechanics' lien law, Va. Code title 43, chapter 1, gives unpaid parties a lien on the property, which can be released by a bond under §§ 43-70 and 43-71; public jobs use payment bonds instead.
Virginia Notary Bond
Virginia notaries are not required to post a bond. The Secretary of the Commonwealth issues four-year commissions.
Virginia Freight Broker Bond (BMC-84)
Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
