Iowa Performance & Payment Bond

Iowa Code chapter 573 requires a surety bond on public improvement contracts of $25,000 or more, covering performance of the contract and other legal requirements. The bond must be at least 75% of the contract price.

License bondRequired by state law

Iowa Contractor License Bond

Iowa contractors must register under Iowa Code chapter 91C. An out-of-state contractor must file a $25,000 surety bond, or show it is prequalified to bid on Iowa DOT projects; the bond secures taxes owed to the state.

Court and release bondRequired by state law

Iowa Mechanic's Lien Discharge Bond

Under Iowa Code section 572.15, a mechanic's lien may be discharged at any time by submitting a bond to the administrator in twice the amount of the lien claim.

Iowa Subdivision Bond

Under Iowa Code section 354.8, cities and counties review subdivision plats and may require public improvements as a condition of approval. Any bond or guarantee for those improvements is set by local ordinance.

Iowa Maintenance Bond

No Iowa statute requires a maintenance bond on every job. Iowa Code § 573.2 requires a performance bond on public improvement contracts of $25,000 or more and refers to maintenance bonds that a public improvement contract may require, so whether one is needed, and its amount and term, is set by the contract.

Permit bondRequired by state law

Iowa Right-of-Way Bond

Iowa DOT may require a performance bond for utility work in primary road right of way under 761 IAC 115.3(4), with a minimum of $10,000 per permit or a $100,000 annual statewide bond. A performance bond of at least $100,000 per permit is always required for longitudinal utility occupancy of freeway right of way (761 IAC 115.15(9)).

Permit bondSet by cities and counties

Iowa Permit Bond

Iowa has no statewide general permit bond. Cities set their own; Des Moines, for example, requires contractors working in the city right of way to have a performance and maintenance bond and insurance on file before it issues obstruction and excavation permits.

Contract bondSet by the contract

Iowa Supply Bond

No Iowa law requiring supply bonds was found. Iowa Code chapter 573 sets bonds for public improvement construction contracts, not for purchases of goods, so supply bonds are set by the purchase contract.

Court and release bondRequired by state law

Iowa Stop Payment Notice Release Bond

On Iowa public improvements, unpaid workers and suppliers may file a sworn claim against funds held by the public body under Iowa Code section 573.7. After suit is filed, the general contractor may file a surety bond for double the claim, and the public body then pays out the withheld funds under section 573.16.

Iowa Notary Bond

Iowa does not require a notary bond. Under Iowa Code section 9B.21, an applicant takes an oath and pays a fee to the Secretary of State, and the commission lasts three years.

Iowa Freight Broker Bond (BMC-84)

Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
