South Carolina surety bonds.
The contractor and commercial bonds we arrange in South Carolina. Pick a bond to see what it's for, who requires it and how to apply.
South Carolina Bid Bond
South Carolina requires bid security of at least 5% of the bid on state design-bid-build construction contracts over $100,000.
South Carolina Performance & Payment Bond
State construction contracts in South Carolina require a 100% performance bond and a 100% payment bond. The agency may waive both on contracts of $50,000 or less if the State is protected.
South Carolina Contractor License Bond
Residential builders licensed by the Residential Builders Commission must post a bond of at least $15,000 or show financial responsibility. Commercial general contractors may post a surety bond in place of the net worth financial statement for their license group.
South Carolina Mechanic's Lien Discharge Bond
An owner or other interested person can discharge a mechanic's lien in South Carolina by filing an undertaking of one and one-third times the lien claim, secured by cash, securities or a surety bond.
South Carolina Subdivision Bond
Where local land development rules require site improvements before plat approval, a developer may post a surety bond instead. State law sets the amount at least 125% of the cost of the improvements.
South Carolina Maintenance Bond
No South Carolina statute requires a maintenance bond in general. The state procurement code, S.C. Code § 11-35-3030, requires bid security of at least 5% on construction bids over $100,000 and 100% performance and payment bonds on construction contracts; a maintenance or warranty bond comes from the contract or local rules.
South Carolina Right-of-Way Bond
SCDOT uses a performance bond (SCDOT Form 739) for permits to work in the right-of-way of state highways. SCDOT sets the bond amount.
South Carolina Permit Bond
South Carolina has no statewide permit bond. Counties and cities set their own; for example, Greenville County requires a $5,000 surety bond issued to the County of Greenville before it issues an encroachment permit, and accepts a cash bond refundable after one year.
South Carolina Supply Bond
South Carolina law requires bonds by statute only for construction contracts (S.C. Code § 11-35-3030). For supply contracts, the purchasing agency or buyer decides whether to require a bond, and the procurement code lets the board require a performance bond in other circumstances by regulation.
South Carolina Stop Payment Notice Release Bond
South Carolina does not have a stop payment notice procedure, so there is no bond to release one. On public construction, unpaid suppliers and subcontractors sue on the payment bond under S.C. Code § 11-35-3030; on private jobs they use mechanic's liens under Title 29, Chapter 5.
South Carolina Notary Bond
South Carolina does not require a notary bond. Notaries are appointed by the Governor for a 10-year term, with records filed with the Secretary of State.
South Carolina Freight Broker Bond (BMC-84)
Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
