Arizona Bid Bond
Arizona public works bids must come with a certified check or surety bond for ten percent of the bid amount. Bid bonds are given under A.R.S. § 34-201.
Arizona Performance & Payment Bond
Arizona's Little Miller Act requires the prime contractor on a public building or public work to furnish performance and payment bonds for the full contract price. The performance bond is in A.R.S. § 34-222 and the payment bond in A.R.S. § 34-223.
Arizona Contractor License Bond
Arizona licensed contractors must file a license bond with the Registrar of Contractors under A.R.S. § 32-1152. The amount depends on the license classification and the contractor's estimated annual volume of work in Arizona.
Arizona Mechanic's Lien Discharge Bond
In Arizona, an owner, contractor, subcontractor or lien creditor can record a surety bond to discharge a mechanic's lien under A.R.S. § 33-1004. The bond is 150 percent of the lien demand.
Arizona Subdivision Bond
Arizona cities set subdivision improvement security by ordinance. A.R.S. § 9-463.01 has each municipality regulate subdivisions and prescribe performance bonds, assurances or other security for required streets, utilities and drainage.
Arizona Maintenance Bond
Arizona's two public-works bonding statutes—A.R.S. § 34-222 (Little Miller Act, covering county/city/town public construction) and A.R.S. § 41-2574 (State Procurement Code)—require only performance and payment bonds; neither mandates a separate maintenance or warranty bond by name. No other Arizona statute was found that requires a standalone maintenance bond. Public agencies and private project owners may impose one through contract terms, typically covering one to two years of defect liability after project completion.
Arizona Right-of-Way Bond
ADOT issues encroachment permits for work in state highway right-of-way. Permittees must follow ADOT's bond policy where it applies. The bond amount was not confirmed.
Arizona Permit Bond
No Arizona state statute specifically mandates a permit bond statewide. Individual municipalities set their own requirements: the City of Phoenix requires a Right-of-Way Construction Assurance (cash bond, performance bond, or letter of credit) before issuing a permit for work in public rights-of-way, pursuant to Phoenix City Code Chapters 31 and 32, in an amount equal to the cost of the right-of-way work. Other Arizona cities and counties have similar local rules.
Arizona Supply Bond
Arizona's public-works bonding statutes apply only to construction contracts. A.R.S. § 41-2574 requires performance and payment bonds at 100% of contract price for construction awards exceeding the $100,000 threshold in A.R.S. § 41-2535, but contains no provision for supply-only contracts. A.R.S. § 34-222 likewise covers only construction, alteration, or repair of public buildings and works. No Arizona statute was found that mandates a supply bond on a materials or equipment supply contract; public agencies and project owners may require one through contract terms.
Arizona Stop Payment Notice Release Bond
Arizona has an express statutory stop-notice scheme. Under A.R.S. § 33-1062, an owner, construction lender, original contractor, or subcontractor that disputes a stop notice or bonded stop notice may obtain a release bond equal to 150% of the amount claimed; upon filing and service of that bond on the claimant, the withheld funds must be released promptly. The bond must be executed by a surety company licensed to transact surety business in Arizona.
Arizona Notary Bond
Arizona notaries must submit a $5,000 surety bond to the Secretary of State before a commission is issued, under A.R.S. § 41-269. The bond covers acts during the four-year commission.
Arizona Freight Broker Bond (BMC-84)
Property brokers registered with FMCSA must keep $75,000 in financial security under 49 U.S.C. 13906. A surety bond is filed on Form BMC-84; a trust fund is filed on Form BMC-85.
