What a supply bond is
A supply bond guarantees a supplier will deliver materials or equipment as the contract says. Public agencies and project owners use them on large supply contracts.
In North Dakota
North Dakota's public improvement bond law (N.D.C.C. § 48-01.2-10) covers construction of public improvements over $250,000, not supply purchases. The state Supreme Court held that supplying aggregate to county stockpiles was not construction of a public improvement, so the bond law did not apply. Supply bonds are set by the purchase contract.
You need this bond if you're
- A material supplier on a public contract
- An equipment vendor or manufacturer
- A distributor supplying a large private project
